This privacy policy (this "Policy") explains the practices of Behold Business Intelligence, Inc. ("Site Provider," "we," "our" and "us") regarding our collection, storage, use, and disclosure of your information in connection with your use of this web-based mobile software application, associated websites and apps, or any other services and content offerings (collectively, the "Site") offered by Behold Business Intelligence, Inc. This Policy applies to your use of and access to our Site throughout the world.

 

By accessing or using the Site, you expressly agree to the collection, storage, use, and disclosure of your information as described in this Policy. If you have registered for a Site account, this Policy applies to you and anyone who uses or accesses our Site using your account. 

 

We may change or update this Policy from time to time to reflect changes in our business, the Site, or our practices and procedures, with or without notice to you. We encourage you to review this Policy periodically, especially before you provide personal data directly to us through the Site. Your continued use of the Site constitutes your acceptance of any revised Policy and agreement to be bound by any such changes.

This may be information that you directly provide to us, such as personal information (such as your name, address, email address, and birth date) provided when you subscribe to or use the Site or otherwise submit information to us through the Site.   • Commercial information, such as content, products or services purchased, obtained or considered or other purchasing or consuming histories or tendencies.

  • Information about your interests and preferences, including inferences, such as your communications preferences. In addition to what you provide directly, we infer your interests and preferences from other data we collect, such as the content you interact with while using the Site.

  • Communications, such as from the communications you send to us, such as customer service inquiries, product reviews and other feedback regarding the Site.

  • Other third-party data, consisting of the categories above, collected from third-party sources outside of the Site, such as data from our affiliates, partners or vendors, data brokers or public sources.

We use the information we collect for the following purposes:

 

  • To operate our business, including providing, tailoring, and improving the Site, such as:

  • creating and maintaining your account, processing your account with our Site, and confirming your eligibility to use the Site;

  • For security, legal, regulatory, compliance and enforcement purposes, such as protecting the safety and security of our users and our Site; detecting and preventing abuse, fraud or other unlawful or unauthorized activities; resolving disputes; complying with legal and regulatory obligations; and enforcing our agreements, including our policies and terms of service that govern your use of the Site.

 

We may also use your data in any other manner as disclosed at the time of collection, or when we have otherwise obtained consent. We may also merge, co-mingle, or otherwise combine data about you, including personal information, in furtherance of the uses above.

  • our affiliates, who may use the information to provide and improve the Site, to build predictive models to better understand our users, and for other purposes consistent with this Policy;

  • designated service providers, who may assist us in developing, supporting, and delivering our Site and serving our users, such as providing technical assistance, eligibility verification services, Site analytics, fraud protection, and other support services on our behalf;

  • partners and unaffiliated third parties, including to third parties that own content and technologies used in our products and services to report on and account for use of such content and technologies by our users; and

  • to protect our rights and property or those or third parties or to otherwise protect the safety and security of our users and our Site, including to combat identity theft, to investigate billing fraud and to prevent unauthorized reception of our content or services;

  • where otherwise permitted by law.

 

We may anonymize or aggregate any information we collect so that the information does not identify you. For example, we may share aggregate information with analytics companies, advertisers, or content providers about the volume of use on the Site. You understand and agree that when we share viewing information using a unique identifier that does not reveal who you are, this unique identifier is not considered personal information and you will not assert that it should be treated as personal information.

 

We may also share your data for any other purpose as disclosed at the time of collection, or when we have otherwise obtained consent. Please note that this Policy is not intended to limit our ability to share or disclose aggregated, pseudonymized or anonymized data.

You also have choices about the information you provide directly to us when you register for or use the Site.  Please note, however, that if you choose not to provide information that is necessary to provide certain features of the Site, your use of the Site may not include those features. If you cannot access your account, or if you would like to request that we delete other personal information referenced in this Policy, you may contact us using any of the methods described in the "How to Contact Us" section of this Policy.

 

  1. STORING YOUR INFORMATION

 

Personal information collected by us may be stored and processed in the region in which it is collected. We take steps to ensure that the information we collect under this Policy is stored and processed in accordance with this Policy regardless of where the information is located. By providing personal information in connection with the Site, you acknowledge and agree that such personal information may be transferred from your current location to the offices and servers of Site Provider and our authorized third-party service providers. Our practice when transferring personal information is to rely on standard data protection contract clauses or individual consent.

 

We retain personal information for as long as necessary to provide the Site and fulfill the transactions you have requested, or for other necessary purposes such as complying with our legal obligations, resolving disputes and enforcing our agreements. Because these factors vary for different types of personal information, actual retention periods may vary.

 

  1. SECURITY OF PERSONAL INFORMATION

 

We take a number of steps to protect your information from unauthorized access, use or disclosure.  These steps take into account the sensitivity of the information we collect and use, as well as the current state of technology. This includes, for example, storing your information on systems that have limited access and are maintained in controlled facilities. We also use, and require our vendors to use, industry standard security protocols when processing any payments for your use of the Site.

 

It is important to remember that no system can be guaranteed to be 100% secure. We recommend that you help us keep your information safe by taking reasonable steps such as keeping your passwords private and not disclosing sensitive personal information in places that can be accessed publicly.

We and our providers may use cookies, e-tokens, tags, web beacons, web bugs and other technologies that help us better understand user behavior, tell us which features on the Site are utilized, personalize preferences, confirm sign-in and authentication information, detect fraud, perform research and analytics, and identify equipment and software configurations as compatible with the Site. Third parties whose products or services are accessible or advertised via the Site may also place cookies or other tracking technologies on your computer or device to collect information about your use of the Site.

 

If you are uncomfortable with these technologies, you may disable them on devices used to access the Site or through your web browsers, in each case where such functionality is capable of being disabled. The Site may contain links to websites or applications operated by third parties. Since we do not control third-party sites and are not responsible for any information you may provide while on such sites, this Policy does not apply to those third party sites. For more information on how those third party sites collect, use and share data, we recommend that you contact the operators of those third party sites directly and read their privacy policies before providing any of your information on such sites.

 

We work with a number of third parties to operate the Site.  When we engage third parties in connection with operating the Site, those third parties may collect, use or access your data as needed for them to perform these functions. These third parties are only authorized to use your data as permitted under this Policy, or as disclosed to you at the time your data is collected.  Please note, however, that these third parties may supplement data collected or received in connection with the Site with data they collect or receive through other websites, platforms and services, in accordance with the policies and disclosures posted on those websites, platforms and services.

 

  1. MINOR'S PRIVACY

 

The Site is not intended for use by individuals under the age of 21, and we do not knowingly collect personal information online from individuals under 21. We encourage parents and guardians to monitor their children's online behavior, put parental control tools in place, and teach children not to provide their personal information through the Site without parental consent. If we become aware that an individual under 21 has provided us with personal information, we will take steps to remove such information and terminate such account.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California’s “Shine the Light” law (Civil Code Section § 1798.83) also permits users of the Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
